These terms apply to your use of urbanwindhaven.com, the website of Urban Wind Haven ("we", "us"), a lifestyle and wellness space at 3-5-8 Chuocho, Kagoshima, Kagoshima 890-0053, Japan. By using the site you accept them. If you do not, please do not use the site; you can always reach us by phone or email instead.
1. What the website is for
The website describes four things: yoga classes, community evenings and workshops, a café corner, and lifestyle conversations. It also lets you send us an enquiry. It is not an online shop, it has no booking system and it takes no payments.
2. Information, not advice
Everything on the site is general information about our space and programme. It is not medical, psychological, nutritional, legal or financial advice, and it is not a diagnosis or a treatment. Yoga and relaxation sessions are ordinary wellbeing activities. If you have a health condition, are pregnant, or are unsure whether an activity is right for you, speak to your doctor first. Read the Disclaimer as part of these terms.
3. Programme ideas are not offers
The Events section lists the kinds of sessions we plan. It is not a timetable or a promise that a particular session will take place on a particular date. Nothing on the website is a binding offer. A session, a pass or a consultation is agreed only when we confirm it to you in writing with the date, the fee and the cancellation terms. Before then, no payment is due.
4. Fees and payment
The first 30-minute introductory chat is free. For everything else we state the fee, what it covers and how and when it is paid in our written quote. The website does not publish a price list, and any figure you hear in conversation is only binding once it appears in that written quote. 5. Taking part in a session
You take part voluntarily, and you are responsible for telling us beforehand about anything that bears on your safety, such as an injury, a health condition or a food allergy, and for stopping if something feels wrong. Please follow the instructions of whoever runs the session, treat the space and other visitors considerately, and ask us before taking photographs or recordings of other people.
6. Photographs and images
The photographs on this website are illustrative images chosen to show a mood. They do not show our actual rooms, events, staff or visitors, and nothing in them should be read as a statement about what you will find on arrival.
7. Using the site
You agree not to interfere with the site or its hosting, not to send us unlawful, abusive or misleading material through the form, not to use the form to advertise to us, and not to copy the site's design or text to present as your own.
8. Our content
The text, layout and logo of this site belong to Urban Wind Haven or are used with permission. You may link to the site and quote short passages with credit. Please ask before you reproduce more than that. Illustrative images may be subject to the rights of their original creators.
9. Third-party services and links
The enquiry form is handled by formsubmit.co, the typefaces come from Google Fonts and the map comes from Google Maps. Those services belong to other companies and follow their own terms. We are not responsible for their availability or conduct, nor for the content of any other website that we link to. How these services touch your data is described in the Privacy Policy.
10. Availability and accuracy
We try to keep the site accurate, but we do not guarantee that it is always available, complete or current. Hours, programme ideas and service descriptions can change without notice. Please confirm details with us before you travel or rely on them.
11. Our liability
We are responsible for damage we cause through our own intent or gross negligence, and for anything else the law does not allow us to exclude, including your rights under the Consumer Contract Act. Beyond that, and as far as the law permits, we are not liable for losses that arise from relying on the website's general information, from interruptions of the website or third-party services, or from activities you choose to take part in contrary to medical advice or without telling us about a relevant condition.
12. Governing law and courts
These terms are governed by the laws of Japan. If a dispute cannot be settled by talking, the Kagoshima District Court (鹿児島地方裁判所) is the court of first instance with non-exclusive jurisdiction, as far as mandatory consumer-protection rules allow.
13. Changes
We may update these terms when the site or our services change, for example if online booking is added. The date at the top shows the current version, and the version in force is the one on this page when you use the site.
